For obtaining N1 million under false pretences and forging a court document to sell his father’s house, 47-year-old businessman, Olusanya Ajala, is to spend the next five years in a Lagos jail, a court has ruled.

An Ikeja Chief Magistrates’ Court, which handed down the verdict yesterday, said the accused was guilty as charged.

Chief Magistrate Taiwo Akanni said she found the accused guilty of all the nine counts bordering on obtaining money under false pretences and forgery.

“You are hereby sentenced to five years imprisonment for all the counts without an option of fine.
“The sentence is to start from the day the accused has been in custody; this sentence will serve as a deterrent to others,” she said.

The accused, who resides at 36, Ayede Street, Ifo in Ogun, was first arraigned on April 20, 2015.
The News Agency of Nigeria (NAN) reports that the accused had been in Kirikiri Prison since April 20.

Earlier, the prosecuting Inspector, Clifford Ogu told the court that the offence were committed on March 9, 2015 at Ajala area of Ijaiye, a suburb of Lagos.

Ogu said the accused obtained N1 million from the complainant, Mrs Anita Ojuola, on the pretext of selling his father’s house to her.

“The accused agreed to sell the house to the complainant for N3.5 million and the buyer deposited N1 million into the accused’s account as first instalment.

“The accused also forged a document believed to have been issued by the court giving him power of attorney which he gave the woman as a proof that he owns the house,” he said.

Ogu said the accused also forged other documents that conferred on him ownership right.

“The accused disappeared after he received N1 million from the complainant. Efforts to get him were unsuccessful as his phone was switched off.
“He was later arrested following a tip-off.”
